Prize Description

Each month there will be one competition (each a “Competition”); the details of the prizes together with any restrictions for each month are below

*June * 1 Winner will receive 2 tickets for one show of their choice at the Dublin Comedy Festival. This will include return flights from a London airport and one night room only accommodation in Dublin at a 3 star hotel. This prize does not include travel to and from the venue or airport transfers.

July 1 Winner will receive 2 tickets for one show of their choice of the Edinburgh and Beyond 2007 tour being held at various locations throughout the UK including Cheltenham, Exeter, Swindon, Telford, Cambridge, London, Reading, Hull and Leeds. Further details will be provided on confirmation of winning. This prize does not include travel to and from the venue.

August 1 Winner will receive 2 tickets for one show of their choice of the Edinburgh and Beyond 2007 tour being held at various locations throughout the UK including Cheltenham, Exeter, Swindon, Telford, Cambridge, London, Reading, Hull and Leeds. Further details will be provided one confirmation of winning. This prize does not include travel to and from the venue.

September 1 Winner will receive 2 tickets of their choice for one show of the Brighton Comedy Festival 2007. This will include open return rail tickets from your home to Brighton and one night room only accommodation in Brighton at a 3 star hotel. This prize does not include travel to and from the venue within Brighton.

October The top 5 entrants shall each win the ‘Magners Experience’. This shall include one case of Magners, one case of branded glasswear, one Ice Kular and a bottle opener. Please note receipt of this prize may be contingent on the winner providing Paramount Comedy with proof of age. If on request proof of age can not be supplied to Paramount Comedy the entry will be declared void and the next highest Entrant selected.

November The top 5 entrants shall each win the ‘Magners Experience’. This shall include one case of Magners, one case of branded glasswear, one Ice Kular and a bottle opener. Please note receipt of this prize may be contingent on the winner providing Paramount Comedy with proof of age. If on request proof of age can not be supplied to Paramount Comedy the entry will be declared void and the next highest Entrant selected.

December 1 Winner will receive 2 tickets of their choice for one show of The World Stands Up at various locations throughout the UK including Liverpool and Manchester. Further locations have yet to be confirmed and further details will be provided on confirmation of winning. This prize does not include travel to and from the venue

January ‘08 1 Winner will receive 2 tickets of their choice for one show at The Glasgow Comedy Festival 2008. This will include return flights from a London airport and one night room only accommodation in Glasgow at a 3 star hotel. This prize does not include travel to and from the venue or airport transfers.

February ‘08 The top 5 entrants shall each win the ‘Magners Experience’. This shall include one case of Magners, one case of branded glasswear, one Ice Kular and a bottle opener. Please note receipt of this prize may be contingent on the winner providing Paramount Comedy with proof of age. If on request proof of age can not be supplied to Paramount Comedy the entry will be declared void and the next highest Entrant selected.

March ‘08 1 Winner will receive 2 tickets of their choice for one show of Comedy on Tap. This prize does not include travel to and from the venue.

April ‘08 The top 5 entrants shall each win the ‘Magners Experience’. This shall include one case of Magners, one case of branded glasswear, one Ice Kular and a bottle opener. Please note receipt of this prize may be contingent on the winner providing Paramount Comedy with proof of age. If on request proof of age can not be supplied to Paramount Comedy the entry will be declared void and the next highest Entrant selected.

  • All prizes are subject to availability and Paramount Comedy reserves the right to substitute the advertised prizes (or any element(s) of the advertised prizes) for ones of equal (or greater) value.
  • Insurance is not included.
  • If applicable, once flights and hotel accommodation have been booked they may not be changed.
  • The winner of any hotel accommodation may be required to supply his/her credit card upon check-in at the hotel and will be responsible for all costs other than the room only accommodation costs.
  • The winner will be responsible for ensuring that the winner and his/her travelling companion obtain all necessary travel documentation (including passports and visas if necessary).
  • Paramount Comedy will not make arrangements for additional people to travel with the winner and his/her companion.

General Terms

  • The Competitions will run each month on www.paramountcomedy.com/magners (“the Website”)
  • Entrants must be aged 18 or over and resident in the UK. Unfortunately Entrants from Eire can not be accepted.
  • Entrants may enter a Competition by submitting their comedy clips (each being a “Clip”) to Paramount Comedy in one of two ways; i) via the Website or ii) via a live event. Further conditions apply depending on the means of entry – please see below for more details.
  • Entrants are not limited to the number of different Clips that they upload
  • Entrants may not submit the same Clip more than once to any Competition.
  • Once submitted, Paramount Comedy will review each Clip prior to it being posted on the Website. Paramount Comedy reserves the right to reject any Clip for any reason at its discretion and no correspondence will be entered into. Only those Clips that Paramount Comedy permits to appear on the Website will be eligible for votes.
  • Entrants may be contacted by Paramount Comedy for further information prior to: (i) posting their Clip(s) on the Website; and/or (ii) being able to claim a prize.
  • Each month’s Competition will be open from midday on the first working day of such month and will close at 17.00 on either the 28th of such month or where the 28th is not a working day the first working day preceding the 28th.
  • Clips may only be submitted to a Competition whilst the Competition is open.
  • All Clips appearing on the Website for a Competition will be judged by the users of the Website (“Users”) by voting whilst such Competition is open.
  • Entrants are able to vote for their own Clip(s) and will be counted as Users for that purpose.
  • Users will not be limited in the number of votes they may cast for different Clips, however a User may not vote more than once for any one Clip.
  • In the case where there is only one prize for a Competition, the winner will be the Entrant who submitted the Clip that received the most votes from Users at the close of the Competition. Where there is more than one prize for a Competition, the winners (being the same number as the number of prizes available) will be those Entrants that submitted the Clips that received the most votes from Users at the close of the Competition.
  • Should there be tie and it is not possible to determine a clear winner Paramount Comedy shall decide how prizes should be allocated. Paramount Comedy’s decision will be final and no correspondence will be entered into.
  • Paramount Comedy will contact all winners via email no later than 7 days after the closure of the relevant Competition closes. If for any reason, a winner cannot be contacted or fails to reply to Paramount Comedy within a 7 days from being informed of having won a prize then Paramount Comedy may declare such win void and select an alternative winner. .
  • No cash alternatives are available to any prizes.
  • The prizes are not transferable.
  • Entrants will be deemed to have accepted these competition Terms and Conditions and to agree to be bound by them by entering a Competition.

Means of Entry

Submission of Clips via the Website

  • All Clips must be accompanied by the Entrants’ full details (name, e-mail address and date of birth).
  • The Clips must be submitted in one of the following file formats: avi, mpg, mov, jpg, gif, swf, wav, ppt
  • All Clips must fully comply with these terms and conditions.

Submission of Clip(s) via a Live Event

  • Paramount Comedy’s Producer will be visiting a number of towns and attending a number of events sponsored by Paramount Comedy throughout the year. Entrants may submit their
    comedy Clip(s) by agreeing to be filmed by this Producer. To show agreement to these terms and conditions each Entrant and any Joint Entrant(s) must complete the Release Form attached.
  • The Paramount Comedy Producer will tell all Entrants which month’s Competition their Clips will be entered into at the time of filming.
  • To post those Clips selected by Paramount Comedy on the Website, Paramount Comedy will create a username and password for the Entrant by using the details provided in the Release Form. Paramount Comedy will then email all such Entrants with such details to enable them to change the password should they wish to do so.
  • All submissions must be accompanied by the Entrants’ full details (name, e-mail address and date of birth).

Joint Entrants

  • If more than one person has contributed to a Clip (each a “Joint Entrant”), the Entrant warrants that he/she has obtained all permissions and/or rights necessary from the Joint Entrants) in order to (i) submit the Clip to Paramount Paramount; and (ii) grant to Paramount Comedy those rights purported to be granted hereunder; and (iii) to identify the Joint Entrant(s) with the Clip.
  • If there are any Joint Entrant other than the Entrant, then the Entrant must indicate that this is the case by checking the appropriate tick box in the submission form. Paramount Comedy will then e-mail the Entrant requesting the names and addresses of all such Joint Entrants and the Entrant agrees to provide a complete and accurate response.

Clip Contents

  • All Clips should be live action movies of the Entrants telling their favourite joke and may not contain any animation, third party footage or music
  • Clips must be the original work of the Entrant (along with any Joint Entrants(s), if applicable). Entrants must not copy or reproduce or otherwise infringe the rights of third parties.
  • Clips must not be unlawful or objectionable (including, without limitation, abusive, racist, defamatory, pornographic or obscene).
  • Clips should be of no more than three (3) of minutes.

Rights and Clearances

  • In submitting a Clip, the Entrant grants to Paramount Comedy the irrevocable non-exclusive royalty-free world-wide right in perpetuity:
    (a)to post the Clip on the internet on the Website so that individuals may view the Clip by utilising streaming technology; and
    (b)to use extracts (including, without limitation, stills images) from the Clip in any media in order to promote the Clip, the Website and/or Paramount Comedy; and
    (c)to edit and modify the Clip; and
    (d)to exercise all copyright and other rights with respect to the Clip for purposes incidental to the exercising of those rights specified in sub-paragraphs (a), (b) and© (above).
  • All Entrants warrant, undertake, and agree as follows:
    (a)they have authority to grant to Paramount Comedy all rights granted or purported to be granted to Paramount under these Terms and Conditions; and
    (b)their Clips comprise only the relevant Entrant’s (and Joint Entrants’) own original work and no part of the Clips is based on any pre-existing third party copyright material; and
    (c)their Clips are not obscene or defamatory, and neither the Clips nor any use of them by Paramount Comedy as permitted hereunder is or will be in breach of any contract or any duty of confidentiality and does not and will not infringe the copyright or any other rights of any third party or is not and will not otherwise be unlawful; and
    (d)Paramount Comedy will be under no liability to anyone appearing in the Clips or other third parties rendering services in connection with the making, distribution or exploitation of the Clips; and
    (e)that they hereby unconditionally waive all rights in respect of the Clips specified in Sections 77 to 85 of the Copyright Designs and Patents Act 1988 and all other moral and author’s rights and rights of a similar nature under the laws of any other jurisdiction and have obtained similar waivers from any Joint Entrants.
  • The Entrant agrees that it will at all times indemnify and hold harmless Paramount Comedy against any losses, actions, proceedings, claims, damages, liabilities, costs and expenses arising out of
    (a)any breach or alleged breach by the Entrant of any provision of these Terms and Conditions; and/or
    (b)any copyright and/or trademark infringement, invasion of privacy and/or any other personal property or moral rights resulting from Paramount Comedy’s exercise of those rights granted by the Entrant hereunder.
  • Paramount Comedy shall be under no obligation to utilise any of the rights granted hereunder.

Use of Data

  • Data provided by Entrants and Joint Entrants will be held and processed by Paramount Comedy for purposes of administering the Competitions and/or the Website for so long as is necessary. The winners’ data will also be used for the purpose of supplying the prizes (in this case the data may be transferred to other entities for the purposes of supplying the prizes). The Winners’ names will be published in the winners’ list. Entrants consent for their names to be displayed should they win a prize. Entrant’s (and Joint Entrants’) data will only be used for marketing or other purposes and/or passed on to third parties where the Entrant consents to such use, retention and/or transfer.
  • The Entrant agrees that Paramount Comedy will publish the names of the Entrant and the Joint Entrant(s) (if any) in association with the Clip(s).
  • The Entrant agrees that Paramount Comedy may use the Clip(s) and the names of the Entrant and the Joint Entrant(s) (if any) in order to promote the Clip(s), the Website and/or Paramount Comedy.

Miscellaneous

  • The submission of Clip(s) to the Website by Entrants is done so at their own risk and expense.

    *This competition is not open to Paramount Comedy, Viacom, BSkyB employees or their families, nor to C&C Group PLC and its agencies and employees.

  • Paramount Comedy reserves the right to cancel any competition at any time if it deems such cancellation to be necessary due to events beyond its reasonable control.
  • All competitions and these terms and conditions shall be governed by the laws of England and shall be subject to the exclusive jurisdiction of the English courts.
